Service Instructions Form SER-001(pdf)

Provides a form allowing you to instruct the Sheriff’s Civil Unit as to the service of small claims, summons & complaint, notices, civil bench warrants, Out of State service requests, and other types of legal action.

Writ Services Instructions-forms SER-001 and SER-001A(pdf) 

Provides a form allowing you to instruct the Sheriff’s Civil Unit regarding enforcement of a WRIT (Writ of Execution, Writ of Possession, Writ of Sale, Writ of Attachment, Claim and Delivery Writ).  This may include services such as evictions, a levy on a bank account or funds in possession of a third party, service on a defendant’s business by using “till tap” process, a “keeper installation,” or a “levy and sell.”, personal property and vehicle levies, levy upon the debtor’s interest in real property.

Earnings Withholding Order Instructions 

Complete the WG-001 Applications for Earnings Withholding Order (Wage Garnishment) and the Electronic Writ Declaration. 

Provides a form allowing you to instruct the Sheriff’s Civil Unit regarding service to garnish wages of someone you have a judgment against, after obtaining a Writ of Execution

 

Claim of Exemption (Wage Garnishment) 

Complete the WG-006 Claim of Exemption (Wage Garnishment) (ca.gov) and WG-007 Financial Statement [same as EJ-165] (ca.gov) forms.  Provides a form to request to reduce or stop garnishing wages because you cannot afford the basic necessities of life with the garnishment.  If a claim of exemption is opposed by the creditor, this form will be forwarded by the Sheriff to the court.

Claim of Exemption (Enforcement of Judgment)

Complete the EJ-160 Claim of Exemption (ca.gov)  and, if applicable, the WG-007 Financial Statement [same as EJ-165] (ca.gov)

Provides a form to claim that some or all of your property being levied is exempt from collection of a judgment.  This form is not filed with the court, but instead is filed with the Sheriff. If a claim of exemption is opposed by the creditor, this form will be forwarded by the Sheriff to the court.

 

Claim of Right to Possession

Provides a form to give people who live in the home, but weren’t part of the eviction case, a chance to add themselves into the case to say why they shouldn’t be evicted.
